A collaborative effort of both the police and the court system will ensure a fair trial to the accused persons. In MSNBC article, a family argues on the violation of the eighth amendment by the court. This is due to their father being subjected to an untested lethal injection proposed by the court. This was after their father (Mr. Dennis McGuire) was sentence to death and the only available means was the use of a foreign component in the execution (Clark, 2014). The family argues on the pain and suffering their family member was subjected to by the injection. There argument bases on the rights enshrined in the constitution. The amendment protects individuals from being subjected to cruel means and undefined punishment while in incarceration (Clark, 2014). The children of McGuire are seeking justice by challenging the manner in which their parent was executed. The case brings on board those who violated the fundamental rights of Mr. Dennis McGuire (Clark, 2014). The state attorney introduces a new element by arguing that execution does not guarantee painless death.Focusing on the case one can identify the fundamental rights in the constitution. These rights are protected by the justice system. The system creates a platform where those who feel their rights have been infringed can seek justice. The family argues their claim based on the eighth amendment which protects individuals from excessive punishment by the justice system (Cole et al, 97). Excessive punishment in this case refers to the unusual punishment McGuire was subjected to by the system. The court while sentencing an individual should keep in mind the rights provided for in the constitution and should ensure they are protected. In this case the family felt the then execution was unconstitutional as it denied Dennis his rights while in custody. The family was in support of the sentence but the means used to execute their father is what they find contentious. The police performed their duty by investigating the crime case. The police play a vital role in ensuring individuals is taken through the justice system (Cole et al, 134).The rights of any prisoners are protected by the constitution in that every individual should not be denied these rights. The eight amendments aimed at developing a system where the individuals subjected to the system are fairly judged. The
